Privacy and Retention of Personally Identifiable
Information (PII) Guidelines

Notice

The New York Art Resources Consortium (NYARC) posts its privacy guidelines on the NYARC website. We collect information about current library users only for the purpose of providing library services. This information is shared with our NYARC partners, the libraries of the Brooklyn Museum, The Frick Collection, and The Museum of Modern Art, only for the purpose of providing library services. We do not engage in practices that might place personally identifiable information on public view.

Consent

NYARC keeps all personally identifiable information confidential. We do not disclose personally identifiable information to third parties without consent unless we are compelled to do so under the law or to comply with a court order.

Personally identifiable information provided by email or online form is only used in the course of library business such as updating contact information or answering a research question.

When using certain electronic resources, such as e-books, or services, such as placing document delivery requests or sending NYARC emails, you/we may need to provide personally identifiable information to third parties that they may or may not retain on file.

Access to Your Own Personally Identifiable Information

With proper identification, users can access their personally identifiable information that has been collected by NYARC.

Researcher Records

NYARC researcher records expire every three years. Expired records are deleted from all systems after a one-year grace period.

Checked-Out Items

Records related to items checked out to researchers are retained until the items are returned. After a grace period of seven days, they are deleted from all systems.

Material Requests

Material requests are retained until requests are completed. After a grace period of seven days, they are deleted from all systems..

Questions

Users who have questions, concerns, or complaints about our handling of their privacy rights should file written comments with NYARC by emailing ask@nyarc.org. We will respond in a timely manner and may conduct a privacy investigation

Concerning Copyright

The copyright law of the United States (title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.

Under certain conditions specified in the law, libraries and archives are authorized to furnish a reproduction. One of these specific conditions is that reproductions are not to be “used for any purpose other than private study, scholarship, or research.” If a user makes a request for, or later uses, a reproduction for purposes in excess of “fair use,” that user may be liable for copyright infringement.

The researcher assumes all responsibility and liability for any claim of copyright infringement arising out of, or related to, your use of any reproductions. they agree to indemnify, defend, and hold harmless NYARC and its partners from and against any and all judgments, claims, liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) suffered or incurred as a result of any third-party claim based on their use of any reproductions.

Exceptions

Archives and special collections materials are governed by different privacy guidelines. For more information, email ask@nyarc.org.

Right to Change

NYARC reserves the right to change or update these privacy and retention of personally identifiable information guidelines and will notify users by posting the changed or updated privacy guidelines on its website. Any changes or updates will be effective immediately upon posting to the website.
